We represent the mother of a 14 year old girl who was suffering from headaches. The defendant neurologist prescribed 200 mlg of desipramine without doing any kind of a cardiac work up. The child died of a desipramine overdose 33 days later. The defendant surrendered his license after charges were filed in connection with unrelated malpractice upon eleven of his patients. I am preparing to depose Dr. Stephen D Silberstein of Philadelphia Pennsylvania who is testifying in behalf of the neurologist. I would be interested in any experience anyone has had with Dr. Silberstein and I will be happy to make his deposition available to anyone who wants it upon request.

While everyone has received a warranty on something that they have purchased, few stop to read “the fine print.” Reading one may cause you to wish that you had not. Typically, the warranty will provide that the manufacturer and/or distributor will “repair or replace,” at their option, the product or part of the product that is defective. Remember – a warranty is not a guarantee of perfection. It is a promise that if the product is defective, it will be repaired or replaced.

I was pleased read in the NY Times that doctors and health insurers are making progress towards developing a national set of standards to grade physician performance. If the rankings are made readily accessible to the public this will be a boon for patients and for the overwhelming majority of physicians who provide quality medical care. In the mean time, I advise family and friends who are facing a serious medical procedure to find out who doctors go to when they need the procedure.
Sometimes we do not realize how good we have it. Recently I had a very practical reminder of how fortunate Americans are to have our system of justice.
