Peter F. Burns

Peter F. (Pete) Burns graduated from Centre College of Kentucky in 1971 where he was captain of the wrestling team and two-time conference champion. He graduated from Cumberland School of Law Cum Laude in 1975. While at Cumberland, Mr. Burns served as the Executive Editor of Cumberland Law Review and was a member of the Order of Barristers. He was also a member of the three-person Regional Championship Moot Court Team. From 1975 to 1976 he was Law Clerk to Associate Justice Hugh Maddox, Supreme Court of Alabama.

Mr. Burns’s practice areas include business litigation, will contests, medical malpractice, legal malpractice, and other matters of complex civil litigation. Mr. Burns relies heavily upon computer software for litigation support and was designated as Summation's featured litigators for two to five person firms. He is licensed to practice before the United States Supreme Court, Supreme Court of Alabama, United States Courts of Appeals for the Fifth, Sixth, and Eleventh Circuits, and in the Northern and Southern Districts of Alabama. Mr. Burns is a Certified Alabama Mediator; Board-Certified Civil Trial Advocate, National Board of Trial Advocacy; and a member of the following: the American Bar Association, the Alabama Bar Association, the Alabama Trial Lawyers Association, the South Alabama Trial Lawyers Association, and the Mobile Bar Association (Chairman, Law & Technology, Civil Practice, State & County Courts Committee).

Mr. Burns has been married to his wife, Renea, for 30 years and together they have two grown children – Erin, who is a graduate of Rollins College and has a Master’s Degree in Marriage and Family Counseling, and Peter, who is a senior at Centre College of Kentucky. Both Pete and Renea are members of Christ United Methodist Church.

Mr. Burns’s past and/or present civil affiliations include: Downtown YMCA, former President, Board of Directors; Municipal Park Baseball, former Board of Directors; Mary B. Austin Parent-Teacher Association (PTA), former PTA President, 1988; Mirror Lake Racquet Club, Chairman of the Board of Directors, 1998-1999; Leadership Mobile 2000; and Habitat for Humanity, President, 2004.

William M. Cunningham, Jr.

Born in Mobile , Alabama, William M. Cunningham, Jr. was raised in nearby Jackson. He attended the University of the South, Sewanee, Tennessee where he played baseball and was named the Outstanding Senior Athlete of his class. After being commissioned as Second Lieutenant in the U.S. Marine Corps he attended Cumberland School of Law in Birmingham, Alabama.

After graduation in 1974, he returned to active duty for four years. While on active duty he augmented as a regular officer and achieved the rank of Captain. During his last three years of military service he was a JAG officer at the Marine Corps Recruit Depot in San Diego, California where he tried numerous criminal trials from unauthorized absence to homicide. He resigned his commission and was discharged in 1978. He returned to Mobile and joined the firm of Sintz, Pike, Campbell & Duke. His work there for 12 years was concentrated in civil defense with an emphasis on products liability.

In 1991, he joined Pete Burns and Pete Mackey in this firm. He now concentrates his practice in nursing home abuse, personal injury, wrongful death, business litigation, environmental matters, and insurance matters. Mr. Cunningham is licensed and permitted to practice in the state and federal courts of both Alabama and Mississippi, as well as the U.S. Court of Military Appeals (1975), U.S. Court of Appeals for the Fifth Circuit (1980), and the Supreme Court of the United States (1985). He also represents the 13th Judicial Circuit as a Bar Commissioner, serves on a State Bar Disciplinary Panel, and is a member of the Board of Directors for Legal Services Alabama. In addition, he is an “AV” rated lawyer by Martindale-Hubbell – the highest rating a lawyer can receive.

Mr. Cunningham is also board certified as Civil Trial Advocate by the National Board of Trial Advocacy, and is certified as an Alabama Mediator. In addition, he is affiliated with the following professional organizations: American Association for Justice, Nursing Home Litigation Group; Mobile Bar Association; Alabama Bar Association; Alabama Trial Lawyers Association; Mississippi Bar Association; and Mississippi Trial Lawyers Association. He has served on numerous civic boards and organizations.

He is married to Kathryn Northcutt Cunningham, a retired internal medicine doctor. She now consults with the firm assisting in medical litigation matters. They have three children: Elizabeth who is a lawyer in Missoula, Montana; Anne who is a salesperson for a national pharmaceutical company residing in Tampa, Florida; and Mary Kathryn, a student at Auburn University. They are active in the Episcopal Church of the Advent in Lillian, Alabama.

Peter S. Mackey

I like what I do. I represent people and small businesses in cases that end in a jury trial. Hopefully, during that process I am able to help these folks get through a tough period in their lives. My working philosophy is that no prospective client walks into my office to tell me what a great day they have just had.

I was born in Fairfield, California. I graduated from the University of Alabama in 1978 and Cumberland School of Law, Cum Laude, in 1983. While at Cumberland, I was an Associate Editor for the American Journal of Trial Advocacy and was a member of Curia Honoris. After graduating, I clerked for the Honorable Emmett R. Cox, then a United States District Court Judge (now on the Eleventh Circuit Court of Appeals).

Over the next three years, I practiced primarily defense litigation. A desire to represent people and try cases led me to Pete Burns in 1987 and, in 1988, we formed the partnership of Burns & Mackey. Initially, I concentrated my practice on plaintiffs’ personal injury, domestic relations and criminal cases. Since 1993, I have focused my practice on civil trial litigation, the overwhelming majority of which involves representing plaintiffs. My caseload today centers on nursing home negligence, business and consumer torts, residential construction cases, employment lawsuits, and insurance matters. I am a member of the American Association for Justice, the Alabama Trial Lawyers Association, the South Alabama Trial Lawyers Association, the Alabama chapter of the National Employment Lawyers Association, the Alabama Bar Association and the Mobile Bar Association. I have been admitted to practice in Alabama and in the Fifth and Eleventh Circuits.

Carol and I have two children. Catherine is a junior at the College of Charleston and Russ is a freshman at the University of Alabama. Carol has her own career in the infusion therapy field. Like my partners, our child raising years revolved around coaching youth sports. I have been active with the local YMCA and we are members of All Saints Episcopal Church. I also serve on an independent review board – we act as the patient’s advocate in reviewing materials for proposed pharmaceutical studies. These days, I spend my leisure time fishing, playing tennis, talking to my dog and laughing with friends and family.
